1. Acceptance of Terms

By accessing or using AppBuilder ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

AppBuilder is a no-code platform that allows users to create custom business applications. The Service includes:

• Creating and managing workspaces and applications
• Defining custom data schemas and storing records
• Building views, dashboards, and automations
• Collaborating with team members
• Accessing data via our API

3. Account Registration

To use the Service, you must:

• Create an account with accurate and complete information
• Be at least 16 years old (or 18 in some jurisdictions)
• Have the authority to bind any entity on whose behalf you register
• Keep your password confidential and secure
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to use the Service to:

Responsibility: You are solely responsible for Your Content and ensuring you have the rights to upload it.

Backup: While we maintain backups, you are responsible for maintaining your own copies of important data.

6. Intellectual Property

The Service, including its design, features, and code, is owned by AppBuilder, Inc. and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the Service
• Reverse engineer or decompile the Service
• Remove any proprietary notices
• Use our trademarks without permission

7. Pricing and Payment

Free Plan: The free plan is provided at no cost with certain limitations.

Paid Plans: Paid plans are billed in advance on a monthly or annual basis. Prices are in USD and exclude applicable taxes.

Changes: We may change prices with 30 days' notice. Price changes take effect at the next billing cycle.

Refunds: Fees are non-refundable except where required by law or stated in our refund policy.

Cancellation: You may cancel at any time. Access continues until the end of the billing period.

8. Service Level

We strive for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible.

9. Support

Support is provided based on your plan:

• Free: Community support and documentation
• Pro: Priority email support (4-hour response during business hours)
• Enterprise: Dedicated support with SLA

10. Confidentiality

We treat Your Content as confidential and will not access it except:

• To provide and improve the Service
• To respond to support requests
• To comply with legal requirements
• With your consent

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your requirements
• The Service will be uninterrupted or error-free
• Results obtained will be accurate or reliable

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPBUILDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100 IF YOU HAVE NOT PAID ANY FEES.

13. Indemnification

You agree to indemnify and hold harmless AppBuilder and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Service
• Your Content
• Your violation of these Terms
• Your violation of any third-party rights

14. Termination

By You: You may terminate your account at any time through your account settings.

By Us: We may terminate or suspend your account for violation of these Terms, non-payment, or extended inactivity.

Effect: Upon termination, your right to use the Service ceases. We will delete Your Content within 30 days unless legally required to retain it.

15. Dispute Resolution

Governing Law: These Terms are governed by the laws of the State of California, USA.

Arbitration: Any disputes shall be resolved through binding arbitration in San Francisco, California, except for injunctive relief.

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions.

16. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and AppBuilder.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any provision does not constitute a waiver.
• Assignment: You may not assign these Terms without our consent.
• Notices: We will send notices to the email address associated with your account.
